Anderson Environmental Coronavirus (Covid-19) Protection

We will be continuing to work during this time to service our clients in accordance with government guidelines. In the business of Environmental Consulting we are fortunate in that we in most cases do not need to meet our clients thus limiting any risk of exposure to Coronavirus. We are often working in the field and 95% of the time have no face to face contact with our clients. Having worked since 1992 as Environmental Consultants and Ecological Consultants as well as in contaminated lands undertaking SEPP 55 and Prelinimary and Detailed Site Investigations we are well aware of the risks of hazards from inhalation of volatile and other hazardous chemicals.

SEPP 55 – Expect The Unexpected

Many of our long term clients such as Land Developers understand the process and risks very well however to clients not familiar with the process it can be somewhat confusing why their Council is requesting a report for Contamination for their Development Application. The reason for a request from council for a SEPP 55 contamination assessment, also called a Preliminary Site Investigation or Stage 1 Contamination Assessment is to determine if the site has the potential to be Contaminated.

Contamination and Real estate risk. Recent revelations regarding the Sugar Cube apartment development at Erskineville in Sydney regarding toxic contamination which may not have been correctly remediated by the developer have caused major concerns regarding contaminated land and real estate.

Contamination and Real estate risk

In this case the City of Sydney is refusing to let apartment owners move in due to concerns the land has not been remediated fully to remove the contamination present. Unfortunately properties and land in the older areas of many cities come with long histories of industrial, manufacturing or other activities such as dry cleaners and petrol stations which often results in quite serious land contamination. These potentially contaminating activities can result in soil and groundwater contamination. In this case the apartments have been built at the old Ashmore industrial estate In Erskineville. Pre-Purchase Site Inspections for Contamination.

At Anderson Environmental we are often asked by our clients to provide advice early on in the development assessment process.

Pre-Purchase Site Inspections for Contamination

Often this commences even before a client decides to purchase a property and it is generally the larger and more experienced property developers who know the value of getting a thorough Due Diligence Pre-Purchase Inspection undertaken. Often we are advising client’s on properties in the millions and have recently advised a client on a 10 million dollar property before they decided to purchase. So what is the role of a Pre-Purchase Due Diligence Inspection for potential contamination ? Most often a Due Diligence Pre-Purchase Inspection involves a combination of reviews of existing records from both the site and its surrounds combined with a walk over site inspection. Detailed Site Investigation (DSI) Phase II Environmental Site Assessment – Bilpin Petrol Station

The work involved assessing the potential impacts of the previous use of the site in regard to potential contamination from the petrol station in relation to a proposed bakery being developed on the site. Whenever any site is purchased (or preferably before purchase) it is important to ensure it is fit for the purpose for which it is proposed to be used. Often these are requested by councils for sites with a history which may indicate there is potential for contamination or for sites with an unknown site history. Whilst some clients see this is unnecessary it is important to understand that the potential risk to human health can be high and that it is a legislative requirement for government authorities to be cautious about such risks. For Preliminary Site Assessments and Detailed Site Assessments consent authorities are required to adhere to the requirements of legislation including SEPP 55 and the National Environmental Protection (Assessment of Contamination) Measure. For risk management and due diligence, we highly recommend that our clients undertake at least a Tier 1 Preliminary Site Assessment (PSI) before they purchase any land. Contamination is a potential threat to the value of your property and any potential purchaser in Australia of property should have a Preliminary Site Investigation (Contamination Assessment) undertaken prior to purchase.

Contamination Assessment Can Help Protect Value of Your Property

Generally Australia has somewhat lagged behind areas like North America in the Due Diligence assessment prior to purchase of real estate. The recent articles in the Sydney Morning Herald indicate to the public how widespread contamination can be and its potential impacts to properties hundreds of metres from the point of contamination. The potential for human health impacts can be high due to dangerous chemicals in the soil or watertable from direct contact or vapour intrusion into residential buildings.
