Paternity Issues in California. Just as a mother in California has legal rights and responsibilities, so does the father of a child.
However, there are instances when a woman claims that a man is the father of a child while the man in question denies paternity. It is also possible for a man to believe he is the father of a child while a woman says he is not. Determining the father’s identity can be an invasive process and can result in a man paying financial support for years.
Some men find they are defending themselves against accusations of paternity, while others may struggle to prove their parental rights. If you are facing a paternity suit or other issue, it is important that you protect yourself by speaking with an attorney at the Men’s Legal Center. Legal Assumptions and Declarations California law makes certain assumptions about paternity. Study Reveals Women Do Not Think Favorably of Shared Custody. In recent years, several different jurisdictions have moved towards a presumption of shared custody of children when the parents of a child or children split up.
The reasoning for this move in general has been to promote the best interests of the child who would be better served by maintaining a close relationship with both parents. While this shift has had many positive effects, it seems that some of the negative results based on the perceptions of those involved are beginning to come to light. One example of this development involves the release of the results of a study performed by researchers at Kansas State University. They reviewed the situations of 20 women who had been involved in shared custody arrangements with the fathers of their children. 18 American States Consider Smoking When Deciding on Child Custody. When parents of a child decide that they need to pursue a divorce and they have children, the situations can often turn nasty if the custody of those children is an issue that’s contested.
There are several different factors that judges can consider when making this critically important decision, and one of those factors that’s been used increasingly across the United States is whether one or both parents smoke and whether a child could be harmed by exposure to it. As of now, 18 different states, including California, will consider the issue of smoking when deciding on child custody. Apparently, this development is catching on in different parts of the world, as Saudi Arabia has announced that judges overseeing divorces can also consider the presence of secondhand smoke when deciding on the custody of the children from a marriage.
Law Dealing with International Child Custody Disputes. Many people have children together and live in the United States where one of the parents has the option to move back to his or her native country.
Unfortunately, when that international parent wants to move without his or her partner, a nasty child custody battle can and often does erupt. Several countries around the world have signed on to The Hague Convention on the Civil Aspects of International Child Abduction treaty, which basically protects the right of the non-moving parent. However, not every country is a party to this agreement, and when a parent in a child custody dispute takes a child to one of the countries not involved in it, the situation can quickly become untenable. That’s because the courts in these non-participating countries are at best unpredictable in terms of what they will decide regarding where that child should live.
As a result, many children are basically abducted from the United States and they never return. Factors Relevant to Child Custody Decisions in California. When parents of a child or children decide that they need to pursue a divorce, they obviously face a very difficult situation.
Not only is their marriage ending, but their family is being torn apart and will have to learn to live in separate homes in the future. This reality can lead to much in the way of hesitation and other negative emotions, and fathers who face a contested battle for child custody often must overcome many doubts in order to properly protect their legal rights. This is much easier said than done in most situations. Fathers should also know that there are many factors that could be considered by a court when it is attempting to decide on a child custody arrangement pursuant to a divorce case. Below you will find a brief overview of these factors that will be presented in the way that a court could approach them. The Best Interests of the Child or Children Other Considerations. New Arizona Law Encourages Joint Parenting after Divorce. For generations, child custody battles have been as nasty as any legal issue can get, as emotions tend to run high and logic tends to disappear when parents are dealing with this situation.
Part of the reason for this intensity is that for most of this time, one parent would generally ‘win’ the case and the other would lose. Divorce Granted in Saudi Arabia between Husband, 70 and Wife, 15. When people consider the laws that exist in California regarding divorce, child custody and anything else that’s related to the family, they tend to think that these are draconian standards that are unduly harsh.
While many people feel this way based on experience, sometimes it’s a good idea to take a step back and consider just how differently these norms are seen in different parts of the world. The most recent example in this regard comes from Saudi Arabia. It has been reported in recent days that a 70-year-old man was granted a divorce from his 15-year-old wife. This divorce may have been granted after the situation was on the receiving end of intense pressure from several different human rights groups, and the laws in that country are such that the marriage is now considered to be dissolved. Unfortunately, it appears that the girl ran away from her new home soon after she was married. Utah Considers Lowing Age When Child Can Have Input on Custody.
Almost every jurisdiction in the United States follows the standard that involves the best interests of the child with regards to the question of child custody when parents are pursuing a divorce. Despite this relative state of uniformity, there are many differences with regards to the details that support this standard. However, some states are attempting to provide themselves with more details so that these court proceedings can be more predictable for everyone involved.
Utah is the latest jurisdiction to consider such a step. LGBT Parents Face Bias in Custody. A new study suggests that LGBT parents may face more bias in court regarding child custody than heterosexual parents. Court decisions tend to favor a heterosexual parent as a choice for custody over a gay or lesbian parent, Drexel University researchers found. While previous research shows that gay parents are as effective as their straight counterparts in parenting skills, and that children raised by gay parents are as well-adjusted as those raised by heterosexual parents, there still tends to be favoritism for straight parents over gay parents when it comes to awarding custody. The researchers hope that this new research could impact how courts make custody decisions. Restrictions on Gay Parents The study found that in many states a partner who “comes out” and leaves a heterosexual relationship may risk losing custody of the children and even having visitations restricted.
