Presque tous les états ont ratifié la Convention relative aux Droits de l'Enfant (193 pays sont Etats Parties) qui garantit un procès juste et une assistance juridique pour les jeunes suspects. C'est pour cela que le problème n'est pas la théorie mais celui de l'application pratique. Bien que la majorité d'états ai ratifié la Convention et ai mis en œuvre une législation nationale conformément à ce qui est prévu dans la Convention (ce qui continue à être insatisfaisant dans beaucoup de cas), ils échouent dans la mise en œuvre. Il existe plusieurs raisons pour ce manque d'application, ceci dépend surtout de l'état économique du pays et du manque d'information. D'un côté, il faut informer les enfants sur leurs droits, mais les autorités publiques (surtout la police et les vigilants) doivent savoir comment se comporter et traiter les mineurs délinquants. Travailler avec des enfants en conflit avec la loi est une tâche multidisciplinaire à cent pour cent.
