Two days later, the state of Tennessee charged her with assault. Loyola is the first woman to be arrested under a new law in Tennessee that allows the state to criminally charge mothers for potentially causing harm to their fetuses by using drugs. The legislation, which officially took effect about a week ago, stipulates that “a woman may be prosecuted for assault for the illegal use of a narcotic drug while pregnant, if her child is born addicted to or harmed by the narcotic drug.”

The decision rolls back a proactive policy intended to safeguard women’s access to reproductive health care in the face of persistent harassment and intimidation from abortion opponents. “By its very terms, the Act restricts access to ‘public way[s]‘ and ‘sidewalk[s],’ places that have traditionally been open for speech activities and that the Court has accordingly labeled ‘traditional public fora,’ ” the opinion states. Reproductive rights advocates had been hoping the justices would uphold the policy, which they say has gone a long way to ensure that woman can safely enter abortion clinics. A Woman Wants To Tell You The 5 Most Surprising Things About Her Abortion

In the two weeks since my husband and I found out at our 20-week sonogram that our fetus was abnormal, I’d barely left the house. My entire world collapsed. The baby I had loved since before he was conceived was deemed by doctors “incompatible with life.” My husband told me about a senator from Fort Worth who was filibustering HB-2, a series of restrictions on abortions in Texas that includes a ban on abortions after 20 weeks. Ennis The lawyers representing Marlise Muñoz’s family members, who are suing the Texas hospital that refuses to remove the brain dead woman from life support, have released a statement confirming that Muñoz’s fetus is “distinctly abnormal.” Despite the fact that Muñoz is clinically brain dead, and therefore considered to be deceased under Texas law, hospital officials have been keeping her body on life support because she was 14 weeks pregnant when she lost consciousness.

Muñoz’s family has repeatedly pointed out that the fetus may have suffered severe abnormalities as a result of Muñoz’s brain death. According to the lawyers, the fetus has severe deformities in its lower extremities, so its gender is impossible to determine.

Meet America's Most Hated Doctors. How Texas’ abortion law scares women out of seeking care. Shortly after Texas passed its sweeping abortion restrictions in 2013, researchers at the University of Texas released a report estimating that 22,000 women would be denied medical care as a result of clinic closures and service reductions across the state. Put another way, Texas’ draconian new law will strip roughly one in every three women seeking an abortion of the ability to meaningfully exercise that choice.

But talk to clinic workers and women in Texas, and you will hear another important barrier to access that is about more than just long trips to providers, the cost burden and other impediments. There is a creeping mentality among Texas women that abortion is simply not an option in their state, that the procedure has become so heavily stigmatized to the point where many women likely don’t consider the option when they become pregnant. It’s a problem Olga Khazan ran up against while reporting a story for the Atlantic on the crisis unfolding in Texas. You can read the rest here.
