Allahabad High Court stays criminal proceedings against man booked for expressing grief on social media over death of his wife during medical treatment. The Allahabad High Court has stayed criminal proceedings against a person, who has been booked for expressing anguish over the death of his wife during the medical treatment in a Facebook post.
A Single Bench of Justice Yogendra Kumar Srivastava on Tuesday passed this order, while hearing an application filed by Ashok Kumar Gautam under Section 482 of CrPC. The application sought quashing of the charge sheet dated October 31, 2020, as well as summoning order dated January 20, 2021, and the entire proceedings of the case, pending before a Meerut Court. The Senior Counsel submitted that the proceedings have been initiated pursuant to an FIR dated July 25, 2020, containing allegations that primarily relate to a Facebook post, which is essentially an expression of anguish of the applicant due to the death of his wife during the course of her medical treatment. The Jabalpur Bench of Madhya Pradesh High Court has disposed of a Public Interest Litigation (PIL), alleging encroachment by private respondents on a government land.
The PIL has been filed by Aam Janta Mouja Mahidal Kala through its Secretary Baijnath Sen, alleging that despite the order passed by the Tehsildar, Circle Chhiboura, Tehsil Rampur Baghelan, District Satna for the removal of encroachment, so far no action has been taken by the government authorities to free the land by private respondents. The petition further contended that the Tehsildar, by order dated January 25, 2020, has not only directed for removal of the encroachment, but also imposed a fine of Rs 5000 on each of the private respondents, who have constructed certain Pakka structures on public land, reducing the width of the road, which has made it difficult even for two wheelers to pass through the same.

The Lucknow Division Bench of Justice Ritu Raj Awasthi and Justice Dinesh Kumar Singh on Friday gave this order on a petition filed by the victim’s father. As per the victim’s statement, she was allegedly raped by one Sarvesh, after which she got pregnant. On her complaint, an FIR was lodged against the accused. The Writ Petition sought a direction to opposite party No 3 (Chief Medical Officer, Hardoi) to abort the petitioner’s child, which was about 18 weeks, as per the medical report. Earlier on July 9, 2021, the Court directed the Additional Chief Standing Counsel to communicate the order to the Vice-Chancellor of King Georges Medical University to constitute a Medical Board for medical examination of the victim.

A Single-Judge Bench of Justice Syed Altab Husain Rizvi passed this order, while hearing a criminal appeal filed by Ganga Sagar Verma, father-in-law of the deceased woman. The Criminal Appeal has been filed against the order dated November 15, 2019 passed by Additional Sessions Judge, Ballia in a case registered under Sections 498A, 304B IPC and 3/4 Dowry Prohibition Act, Police Station Sahatwar, District Ballia.
The maximum sentence awarded in this appeal is 10 years of rigorous imprisonment and fine of Rs 10,000 and in default of payment of fine one year, additional rigorous imprisonment under Section 304-B IPC, against which this appeal has been preferred.

The Bench comprising Chief Justice D.N. Patel and Justice Jyoti Singh issued a notice in the petition highlighting the sale of Shein products on Amazon.in. Senior Counsel Vivek Raj Singh, appearing for the petitioner, informed the Court that in June 2020, 59 Chinese applications were banned by the Government of India, including Shein, to protect the integrity and sovereignty of India. He submitted that for a Prime Day Sale scheduled for July 26 and 27, Amazon.in has advertised for a sale of products from Shein on its platform. The matter is slated for August 20.

Delhi High Court seeks Centre's stand in plea challenging constitutional validity of IT Rules, 2021. The Delhi High Court, on Thursday, sought the stand of the Centre in a fresh plea filed challenging the constitutional validity of Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which were notified by the Central Government on February 25’ 2021.
The Bench comprising Chief Justice D.N. Patel and Justice Jyoti Singh issued a notice in the petition by an Advocate, who is affected by the said Rules. The matter is slated for September 13’ 2021. Advocate Uday Bedi, being a user of various Social Media Intermediaries (SMIs) including WhatsApp, Instagram and Twitter, has challenged Rules 3 and 4 of the IT Rules, 2021, for encroaching upon the privacy in personal communication of the user and thereby, being unconstitutional and ultravires of the parent Act, I.e. Information Technology Act, 2000.
Rs 1 crore ex-gratia: Delhi HC adjourns plea of Covid-deceased constable's widow for release of money, Kejriwal's office had announced relief. The Delhi High Court adjourned till October 4 hearing a plea seeking ex-gratia amount to the family members of a Delhi Police Constable who lost his life to Covid-19 on May 5, 2020, while serving as a frontline warrior in the fight against the Covid-19 pandemic. The decision came in light of the statement by Santosh Kumar Tripathi, Standing Counsel for the Delhi Government, before the Bench headed by Justice Rekha Palli, seeking time to place on record certain policy documents. Petitioner’s counsel Sundeep Sehgal claimed it to be delaying tactics. The petitioner relies upon a tweet made from the Office of the Chief Minister of Delhi on May 7, 2020 which read, “Delhi salutes Ct Amit, the brave Delhi Police official who lost his life to corona while serving the people of Delhi. Hon. CM Arvind Kejriwal has announced that Amit’s family will be provided Rs 1 crore ex-gratia.”

A Public Interest Litigation has been filed in the Supreme Court seeking directions to the Union of India to constitute the Goods and Services Tax Appellate Tribunal New Delhi, on an utmost priority basis in the interest of justice. The PIL has been filed by Advocate Amit Sahni and Preeti Singh is the Advocate On Record for the Petitioner. According to the petition, the GST Bill introduced in 2016 passed both the houses of the Parliament, and from 1st July 2017, the Central Goods and Services Act came into force.
Section 109 of the Act mandatesd the constitution of a GST Appellate Tribunal which is not constituted even after 4years of the Act being into existence. The Union Of India issued a notification thereby clarifying its stand regarding the non-constitution of the Appellate Tribunal.
Making Justice Easy, Accessible. The Union cabinet on July 14 approved the continuation of the Centrally Sponsored Scheme (CSS) for the development of infrastructure facilities for the judiciary for a further period of five years from April 1, 2021, to March 31, 2026. The government’s share of the total cost of Rs 9,000 crore on the scheme will be Rs 5,357 crore, including Rs 50 crore for the implementation through the Gram Nyayalaya scheme and a national mission for justice and legal reform.
The scheme will help in the construction of 3,800 court halls and 4,000 residential units (both new and ongoing projects) for judicial officers of district and subordinate courts, 1,450 lawyer halls, 1,450 toilet complexes and 3,800 digital computer rooms. The cabinet also approved the decision to support Gram Nyayalayas by certifying recurring and non-recurring grants for a period of five years with a total outlay of Rs 50 crore.

A PIL has been filed in the Supreme Court seeking a direction to form a Special Investigation Team under Supreme Court supervision to investigate the Pegasus scandal and prosecute all accused persons/ ministers for buying Pegasus spyware and snooping on citizens of India including judges, opposition leaders, and political persons, activist, advocates, and others for their vested political interest since 2017 under provisions of the Information Technology Act, 2000, the Official Secrets Act and the Indian Penal Code.
The PIL, filed by Advocate Manohar Lal Sharma, further prayed for a declaration that the purchase of Pegasus spyware for snooping is illegal and unconstitutional being violative of Articles 21, 266(3), 267(2) and 283 of the Constitution and that Prime Minister Narendra Modi and his minister jointly and severally liable to return the amount with interest issued from the public treasury without the permission of Parliament.
